These Terms and Conditions ("Terms") govern your access to and use of Calmly Kids operated by Vista Studios Ltd ("we", "us", "our") at https://calmlykids.app (the "Service").

1) Acceptance of Terms

By using the Service, you agree to these Terms and our Privacy Policy: https://calmlykids.app/privacy-policy.

2) Eligibility

You must be at least 18 years old to use the Service and have the legal capacity to enter into these Terms.

3) Accounts and security

You are responsible for maintaining the confidentiality of your credentials and for activities on your account. You agree to provide accurate information and notify us of unauthorized access.

4) The Service

The Service may allow you to (a) download digital assets (including searchable JPEG wallpapers, source files, Blender files, and PSD files) and (b) generate and download AI-based files using images you upload.

5) Subscriptions, credits, and payments

  • Plans/credits: Plans and credits are as described on the pricing page.
  • Pricing: Available at https://calmlykids.app/pricing.
  • Payment processing: Processed by Stripe.
  • Renewals: Subscriptions renew automatically unless cancelled before the renewal date.
  • Refunds: Refund Policy — Refunds are handled in accordance with our refund policy.

6) User content and AI generation

You retain your rights in content you upload ("User Content"). You grant us a limited license to host, process, and transmit User Content solely to operate and provide the Service (including AI generation) and to maintain security/compliance.

You represent that you have all necessary rights to upload and use User Content and that it does not violate law or third-party rights.

7) Acceptable use

  • Do not use the Service for illegal activities or to violate third-party rights.
  • Do not upload content you do not have rights/permission to use.
  • Do not bypass credits, rate limits, paywalls, or security controls.
  • Do not interfere with or disrupt the Service or its APIs.
  • No scraping/bulk downloading except where explicitly permitted.

8) Intellectual property

The Service (software, UI, branding) is owned by us or our licensors and is protected by applicable laws. Your use is licensed, not sold.

9) Downloads and license

Your rights to use downloaded assets and generated outputs are governed by the License: https://calmlykids.app/license. If there is a conflict, the License controls for downloadable assets.

10) Third-party services

The Service may integrate third-party services or APIs. We are not responsible for third-party services, and your use may be governed by their terms.

11) Changes and termination

We may modify or discontinue parts of the Service. We may suspend or terminate access if you violate these Terms or to protect the Service.

12) Disclaimers

The Service is provided on an "as is" and "as available" basis to the maximum extent permitted by law.

13) Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect or consequential damages. Our total liability is limited to the amount you paid us in the 12 months before the claim, except where liability cannot be limited by law.

14) Indemnity

You agree to indemnify and hold harmless Vista Studios Ltd from claims arising from your use of the Service or your User Content.
